Hello, please, I'm about to be granted RSAs with a vesting period from a US company. I wonder what are all the tax implications of that for me as Czech resident living in the Czech Republic. Do I have to tax the RSAs as income (I guess according to §6 ?) when I 'buy' them for some arbitrary (lower than fair market according to the valuation of said company) value before the vesting begins? Do I have to tax them the same way when they vest? If yes, is there any strategy to push the tax duty just to the event of actually selling the vested shares and not tax them as income (because they could end up being worthless) but only tax the profit from the sale as capital gain (I guess according to §10). Hello Tom,
first of all please ask your employer if the company RSA is not taxed in your payroll.
Otherwise the income is taxable in your personal income tax return.
In a first stage you should tax a differnce between market price and vested price according
to Art.6 of Tax Law.

After that you can behave to the stocks standardly.
A capital gains are taxed according to Art.10 of Tax Law.

But the capital gains can be extempted from taxation provided that you keep the stock more than 3 years or
your income (total selling price) doesnt exceed CZK 100,000 per calendar year

you are not obliged to pay income tax prepayments in a first year of your business.
The tax you will pay at once according to your tax return in the end of March 2021.

Dobrý den, chci se zeptat zda bych měl platit daň z příjmu pokud jsem prodal auto 3 měsíce od koupi (šlo o nové auto). Vím že se daň platí pokud auto nevlastním alespoň jeden rok. Má situace je následující. Měl jsem autonehodu a pojišťovna to vyhodnotila jako totální škodu. Pojistné plnění bylo hrazeno z havarijního pojištění a vrak auta pojišťovna dala do aukce a já ho následně prodal. Jde mi o to zda tento prodej je také považován za pojistné plnění či nikoliv. Zda tedy musím částku z prodeje danit či nikoliv. Děkuji za odpověď.

If Restricted Stock Units (RSU's) vested in 2018, should the amount be reported as § 6 Income from employment, or § 8 Income from capital assets? Moreover, if participation in an Employee Stock Purchase Plan (ESPP) in the same year earned profit by acquiring the shares at a higher rate (nominal versus issue rate), should that income be reported as § 6 Income from employment, or § 8 Income from capital assets?

Dear Eric,

if the Restricted Stock Units (RSU) were vested in 2018 you should tax the difference between current market price and discounted price (real purchase price) according to §6.

A resale of the shares shall be taxed according to §10.

According to §8 shall be taxed posiible dividends.
